The lawyer who derailed the Britney Spears conservatorship case tells TMZ Britney herself called him and asked him to take the reigns. The question: Will a judge be buyin’ what he’s sellin’?

Attorney John Eardley filed papers in federal court last Thursday, alleging the California courts have railroaded Britney by imposing a conservatorship. Eardley tells us Britney called him, but he would not disclose the circumstances surrounding the alleged call or what she said. We do know that Michael Sands, who used to be the spokesperson for K-daddy’s lawyer, Mark Vincent Kaplan, is now the mouthpiece for Eardley. And Sands also reps Sam Lutfi, who is now restrained from all things Britney.

So, are Lutfi and Sands behind the whole magilla with Eardley? Smells like it.

Eardley tells TMZ Britney didn’t sign a retainer agreement because she is being “held hostage” in her own home. Ironically, a half hour before he told us this, we looked out our office windows and saw Britney driving through West Hollywood on a shopping spree.

Just by filing the Federal papers, Eardley has paralyzed the California courts from issuing more orders in the conservatorship case unless and until the Federal judge tells Eardley to take a hike.

Sarah Ferguson, the Duchess of York, is reaching out to Britney Spears in an interview with ‘Showbiz Tonight’. “I’m still going to go on reaching out to Britney. I like her,” the WeightWatchers pitchwoman told AJ Hammer. “I think she is a really - she is a good person. And I think she - you know, we all get lost. I got terribly lost, I made endless mistakes the press said and in fact, I’ve written a book of ‘Mistakes I Learned the Hard Way’. I really would love to help her. She keeps being lambasted and told it’s all negative and look at her behavior. When are they going to stop and say it’s OK, we’re here to support you? The American people gave me my second chance. Why don’t they calm down and give her a second chance? Let her heal herself. And I feel very strongly that we need to support her. She is in real trouble. What, are we all happy if something horrendous happens to her? Is that what is going to make us happy? The journalists have to take some responsibility. Stop chasing her. Let her get her life back.”

Should their be a to leave Britney Spears alone law? ‘Showbiz Tonight’ host AJ Hammer spoke with Los Angeles City Councilman Dennis Zine, who is proposing the paparazzi restrictions, as well as Sheeraz Hasan, the founder of Hollywood.tv, who argues the laws won’t work. “I’ll tell you why we need a law. Not only to protect the celebrities, to protect the general public,” Zine argued. “Someone goes out and gets a camera. All of a sudden they’re paparazzi, no credentials. They freelance out there creating chaos on the roads and we have a population in Los Angeles that’s fed up with it. We`re an entertainment capital. We`ve got celebrities all over Los Angeles from Malibu to Beverly Hills. We have an obligation to protect them, the general population and what the paparazzi have done has gotten out of control. They’re creating a hazard for everyone and when we have to spend $25,000 of taxpayers` money to escort an ambulance with Britney Spears to the hospital, we have gone over the top. It is their conduct, their lack of respect for people, the lack of respect for the law, 80 miles per hour down the streets, wrong side of the road, jumping out, swarming cars is what`s creating this. They have created this dilemma. We need to correct it and the way we`re going to correct it is by coming up with some sanctions, some laws to bring back a little sense of decorum and respectability. I don’t care if they take the photo. I don’t care if they do their job, but they have gotten out of control and the numbers keep growing. They’ll be up to 100 paparazzi at a site, up to 100 swarming a car. We can’t tolerate that in our City of Angels.”

Britney Spears and Lindsay Lohan may have both entered (and re-entered) rehab multiple times last year, had run-ins with the law and fooled around with more men than we care to count but that’s not all these two troubled stars have in common: they’re both debuting new makeovers this year as well!

Britney has cleaned up her look over the past week or so, dying her hair darker and cutting it shorter while her former friend is also taking a walk on the dark side, but sporting a longer, fuller hairstyle.

And while Britney’s bod is looking fabulous lately (guess those countless hours in the dance studio are starting to pay off), Lilo also showed off a svelte figure as she arrived at Clive Davis’ pre-Grammy party in a short, figure-flattering teal dress.

While both women continue to struggle for their ultimate career-comebacks, we’re wondering who has a foot up on the competition when it comes to their new looks: the former pop icon or the struggling singer/actress?

After lying low on Valentine’s Day, Britney Spears resurfaced on Friday for another eventful shopping spree up and down Melrose Avenue in Los Angeles.

Carrying a dress on a white plastic hanger, the Gimme More singer was accompanied by her mini entourage and about 45 paparazzi pals to the Betsey Johnson shop.

Wearing a leopard-print top, the troubled pop tart then made her way to the new Monique Lhuillier store before heading over to the always-popular Fred Segal.

Interestingly enough, insiders claim that while shopping at Fred Segal, Brit may have “forgotten to pay for the clothes she changed into and wore out of the store - as she left with a black top over her original outfit.”

The source tells: “The cops showed up at the Melrose store and the paps went wild with rumors that Brit may have had another ‘blue lighter’ moment.”

Fortunately enough, Spears was able to leave the scene without incident - with the police focusing more on managing the throng of photographers rather than Britney’s new shirt.

Meanwhile, as far as her legal matters are concerned, recently released court documents revealed that “the trust where Britney keeps most of her estimated $100 million fortune is out of her hands – and under the control of her brother and a lawyer.”

“This is nothing new,” says Bryan Spears. “This was a decision made some time ago and signed off on by Britney, before she was married to Kevin, before she had kids. As with anyone with a large trust, trustees were named. This is nothing new.”
