A lawyer for Britney Spears was turned down Tuesday in a bid for a gag order on attorneys in the pop star’s child-custody dispute with ex-husband Kevin Federline.
Superior Court Commissioner Scott Gordon rejected the request after attorney Anne Kiley argued that media coverage was “emotionally and physically” dangerous to Spears.
Federline’s attorney, Mark Vincent Kaplan, contended that the absence of a gag order doesn’t leave Spears’ children in jeopardy and that Spears is more concerned about the paparazzi frenzy that follows her.
Kaplan noted that the paparazzi swarms existed before Spears filed for divorce in November 2006.

Britney Spears’ new bodyguards are on strict orders from her dad, Jamie: Don’t let her go to a bar or a bathroom alone! The popwreck went to Jeffrey Chodorow’s new LA restaurant Citrus at Social on Saturday night with her father, a few friends and a woman described as “her chaperone.” The group sat at a table to eat, but Spears hardly touched her lobster burger, preferring butter-fried frites and Tater Tots. When she got restless, her bodyguards, stationed at several places throughout the eatery, jumped into action. “She continuously got up from the table to go to the bathroom or hang out at the bar and smoke a cigarette,” our spy said. “Bodyguards followed her to the bathroom and bar.” Another snitch who saw Spears leave noted, “She took a coffee cup from the restaurant with her.”
It appeared Britney had forgotten her underwear yet again, revealing a tad too much to the awaiting throng of paparazzi as she stepped out of her car.
And after flirting with the Kabbalah and Hinduism in recent years, Britney seems to be returning to her Christian roots as she teamed a silver cross with her ensemble.
After a week under involuntary hold at UCLA Medical Center’s psychiatric ward earlier this month before leaving treatment early, Spears has spent a majority of her time at her Beverly Hills home with her father Jamie.
Britney occasionally ventures out with her family and bodyguards in tow to a store or restaurant, but is never seen alone.
A lawyer claiming to be acting for Britney alleges the singer is being held a prisoner in her own home.
Jon Eardley filed a complaint on behalf of the star in a U.S. District Court last week, alleging her “civil rights” are being violated after her father was granted temporary control of her estate during her hospital stay.
He said: “These are issues of confinement. Very serious confinement. Not allowed to contact her friends. Not allowed to use the phone. Not allowed to come and go as you please. Bodyguards controlling you and so forth.”
Britney is currently unable to see her two young sons Sean Preston, two; and Jayden James, 17 months; who are currently in the custody of their father Kevin Federline.
A court hearing to discuss custody arrangements is scheduled for later today.
It is yet unknown who will represent Britney in court after her last divorce lawyers Trope & Trope withdrew earlier this month.
Reports suggest Britney’s original divorce lawyer Laura Wasser will return to the case.
Britney hasn’t seen her two sons since January 3, when she was taken to hospital on a stretcher following a three-hour stand-off with police.

Britney Spears may have a new lawyer but she continues to be the custody challenged, vagina flashing, restroom frequenting, British Britney in Britney.
Britney has a new lawyer, Stacy Phillips, to represent her in her custody dispute with ex Kevin Federline.
Phillips, who has represented Bobby Brown and Tori Spelling’s ex in the past, is actually Jamie Spears choice, since Britney is under a conservatorship and cannot make the decision on her own.
However, while consenting to the change in her legal representation LA Superior Court Commissioner Scott M. Gordon made it known that he would like Britney to be represented by someone of her own choosing when the conservatorship is vacated.
What Commissioner Gordon did not agree to was to enhance Britney’s visitation rights because the feuding parties, despite being in favor of it, could not settle on the terms. He also did not agree to put a gag order on the lawyers, a request that originated from the Britney camp but was opposed by Kevin Federline’s lawyer Mark Vincet Kaplan. (more…)
Lawyers for Britney Spears and Kevin Federline met at L.A. Superior Court this morning for a hearing in their ongoing custody battle.
Spears’ father Jamie, her temporary co-conservator, was also present, as well as Anne Kiley, Spears’ lawyer from Trope and Trope.
Neither Spears, 26, or Federline, 29, were present.
At the beginning of the hearing, Kiley asked that a gag order be placed on those connected with the case.
A judge denied her request, explaining, “We’re dealing with very critical issues. The hearings are public. The public does have a right to know what the courts are doing.”
The courtroom was then sealed.
Though no major change in their custody arrangement is expected today, Federline wants Spears back in their boys’ lives. (TMZ.com reports that Federline would approve of Spears regaining visitation rights if her parents are also present.)
“It has always been, and it is now and will continue to be, his desire for the children to have their mother in their life under whatever conditions are reasonable, based on progress,” Federline’s attorney, Mark Vincent Kaplan, tells Extra.
It’s been seven weeks since Spears has seen her boys, Sean Preston, 2, and Jayden James, 17 months, and Kaplan says Federline “is doing everything that he can to make up for the fact that the boys are with him and keeping family around and trying to have them not aware that there’s any change whatsoever.
“He’s doing great at being a parent,” Kaplan adds.
Federline, Kaplan says, “is evaluating two or three [acting opportunities] right now, and he’ll decide shortly which one he wants to put his energy into.
“Regardless, it won’t require him to be away from his children on any extensive basis,” Kaplan insists. -us weekly

Los Angeles Superior Court Commissioner Scott Gordon is expected to rule on a request from Trope & Trope to withdraw from the case as Britney’s attorneys in her child custody dispute with ex-husband Kevin Federline at a scheduled hearing on Tuesday, February 19 at 8:30 a.m. PT.
Trope & Trope are believed to be at loggerhead with Britney’s conservators - her father Jamie Spears and attorney Andrew Wallet.
Laura Wasser, who represented Britney before Trope & Trope, is likely to resume charge once again.
Commissioner Scott Gordon is also scheduled to review a tape of Britney jumping a red light with her children and a court appointed monitor in her car, a source told E! News.
In an emergency hearing January 23, Britney’s lawyers requested the court to restore her visitation rights with her son Sean Preston, 2, and Jayden James, 1, “in a therapeutic setting.”
On that day the Commissioner ruled to maintain the status quo till the next hearing. It remains to be seen if court will have the time to consider the pending request during the hearing tomorrow.
Meanwhile, legal experts are weighing in on attorney John Eardley attempts to transfer Britney’s conservatorship case to a federal court. None of them seem to believe Eardley has any chance of succeeding. Some believe his attempts are no more than a publicity stunt.

In light of her recent indescretions and drama, it appears Britney Spears is taking comfort in food. And it’s beginning to show.
The ever-present paparazzi trailing the “Gimme More” singer got some not-so-flattering shots of the pop singer while she was dining at Shu Sushi last night.
As is par for the course, Britney showed everyone that she’s still in the “I don’t wear underwear” club, as was evidenced by some extra-revealing pictures.
Meanwhile, at 8:30 a.m. on Tuesday morning, “Los Angeles Superior Court Commissioner Scott Gordon will convene the latest closed-door session in the ongoing custody case between Spears and ex-husband Kevin Federline.”
According to E! reports: “Among the orders of business: Just exactly who will represent Spears, now that the firm of Trope and Trope has bailed on the case. Laura Wasser, who was Spears’ previous counsel in the case, is expected to be back, but Gordon must sign off on the move first.”
Pop star Britney Spears on Tuesday failed to regain the right to see her two young sons after a closed-door court hearing in the lengthy and bitter custody dispute with her ex-husband Kevin Federline.
Spears, who lost primary custody of her children in October, has been barred from court-monitored visits after refusing to hand the boys back to Federline in January and being taken to a hospital for psychiatric evaluation.

Toxic Britney Spears seems to have forgotten making her last music video ‘Piece Of Me’, after leaving the staff at Hollywood club Social baffled with questions about the venue where she filmed the promo.The mental pop star took over Social for a day to shoot the video last November and spent around 10 hours there, dancing and lip syncing. But, when Spears returned to Social for a night out last Saturday, it appeared she had no recollection of ever shooting the video there. A source tells website Hollyscoop, that Spears chatted with the bemused general manager of the restaurant, asking, “How long have you been open?” and what was upstairs, where she filmed the ‘Piece Of Me’ video.
